Family of injured elderly man promises legal action

Is it a case of law enforcement brutality? You be the judge.

WTVD11 reported the story of a 79-year old man who was injured during an arrest by the Durham County Sherif f’s Department. According to the story, Justo Santander wondered away from home and was reported to law enforcement after he knocked repeatedly on a strangers door.

The elderly Santander has Alzheimer’s and speaks very little English.  The sheriff’s department reported that Santander was unresponsive to their demands. Deputies also reported that Santander was holding a strange object; later discovered to be a plastic cigar tube.  During the struggle, Santander suffered a blackened eye, concussion, and lacerations.  These injuries resulted in a visit to the emergency room.

Family members stated that Mr. Santander was harmless and did not, due to his condition, understand what was happening.  Family members reported that they want the deputy punished for his actions, and they are ready to take legal action if the deputy goes unpunished.
